IMPORTANT - READ CAREFULLY

This license statement constitutes a legal agreement between you (either as an individual or a single entity) and Jaume Sola (owner of CONSERT.NET and WEBBYFILES.COM) for the use of the software product "WebbyFiles Single License" you purchased ( referred herein as "The Software" ).

BY DECOMPRESSING, COPYING, OR OTHERWISE USING THE RECEIVED ZIP FILES, YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THE LICENSE AGREEMENT.

Upon your acceptance of the terms and conditions of the License Agreement, you are granted the use of The Software in the manner provided below.

GENERAL TERMS

The Software is owned by Jaume Sola and is protected by copyright law and international copyright treaty.

The Software includes any files provided to you in the received zip files. This is, the source code, graphics, HTML pages, examples, documentation, etc. It does not include any files or portions of them that include third parties copyright notices or which are of public domain.

Except as provided below, you may not resell, rent, transfer, lease, lend, sublicense, or electronically transmit or distribute The Software, or parts of it, to third parties.

This license allows you to install and use one copy of the software on one production web server, either for internal access (intranet) or for public access (extranet/internet). You may create additional copies exclusively for backup purposes and you may install the software more than once for testing or developing.

Except as mentioned above for backup, testing or developing, if you wish to install the software on several servers, or several times on one server you must purchase a license for each installed copy.

Under this license terms, The Software is intended to be used as a service for sharing files within your organization, with clients, customers, providers or other users as part of your organization normal operations. This license does not allow to use The Software in a web site that obtains its revenue from offering file sharing services.

SOURCE CODE

You may modify the source code or other components of The Software to adapt it to your needs. You are not allowed to copy and paste source code into external files. The source code may only be used within the original files. You may not remove copyright notices from source code files.

Non competition: you agree not to use the knowledge acquired from the source code in order to develop for yourself or any third party any program that is similar to or competitive with The Software.

TRADE SECRETS

You acknowledge and agree that the structure, sequence and organization of the Software are the valuable trade secrets of Jaume Sola. You agree to hold such trade secrets in confidence.

NO WARRANTY

THE SOFTWARE IS PROVIDED ON AN "AS IS" BASIS AND ALL RISK IS WITH YOU. JAUME SOLA MAKES NO REPRESENTATIONS OR WARRANTIES THAT THE SOFTWARE IS FREE OF ERRORS OR THAT IT IS SUITABLE FOR YOUR INTENDED USE.

LIMITATION OF LIABILITY

IN NO EVENT SHALL JAUME SOLA OR ITS SUPPLIERS BE LIABLE TO YOU OR ANY OTHER PARTY FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, LOSS OF DATA OR DATA BEING RENDERED INACCURATE, LOSS OF PROFITS OR REVENUE, OR INTERRUPTION OF BUSINESS IN ANY WAY ARISING OUT OF OR RELATED TO THE USE OR INABILITY TO USE THE SOFTWARE.
